Day One: Hospital Arrest of accused- mass-murderer Zaldy Ampatuan

    It’s 12:48 in the morning, Day One of the hospital arrest (coined from house arrest) at a five-star VIP hospital suite of accused-mass-murderer Zaldy Ampatuan,  of the Ampatuan town, Maguindanao massacre, where the accused in conspiracy are charged with having slaughtered 58 civilians including 37 media workers, two lawyers, and several passersby, in a convoy. The overt acts charged with prima facie evidence include the digging of a giant hole with a government-issued backhoe MR’ed to the name of  one of the accused Ampatuans, and throwing in all the bodies, some of whom could have still been breathing when they were buried.

    It is Day One of his illegal hospital arrest at the posh Philippine Heart Center—if you don’t think this is already Day One of his hospital arrest, your I.Q. may have been diminished from too much exposure to  lead when you were a baby.

  It is Day One of his  continuing violation of the court order which allowed only an out-patient hospital examination, and all the doctors could say was: we cannot divulge the examinations for being privileged. It is not privileged, doctors exercise no jurisdiction because he is an accused and they cannot invoke any kind of privilege – they, the administration of the Philippine Heart Center, the entire staff, the lawyers Howard Calleja and associates, the accused, and all those who allowed this situation are in contempt of court —  and they should be asked to show cause why no warrants of arrest should be issued against them for this continuing violation of the court order; or the court motu proprio (or on its own without need of a motion) can  issue the warrant of arrest for all those who caused this violation and order the immediate return of the accused who is strong enough to issue day-in day-out media interviews, rehearsing, prepping, being briefed, emoting under kleig lights he should be a star in his own telenovela except that it will not sell. If you think “outpatient” includes confinement, sleeping-in, vacation, four days to indefinite stay, then you are dizzy from food poisoning with botcha (spoiled meat) of the fish kill.

     In an excellent backgrounder from GMA 7 news reporter Raffy Tima, all those VIP’s who had been under hospital arrest either as accused or respondents were  enumerated,  to show a pattern of special treatment for the rich and powerful: former Usec and former Palace confidante Jocjoc Bolante, former national security adviser Norberto Gonzales, former governor Antonio Leviste, and of course Erap Estrada. Is this still the state of the criminal justice system under supposedly a new government?

     If you cannot indict Gloria based on a reconstruction of the paper trail laid out in the Garci tapes that you’ve been making phone calls to favor an accused-mass-murderer,  who made you jump up and down with worthless affidavits (worthless, because they are hearsay and not backed by a paper trail), then you have a bunch of incompetents for a legal team. The content of the Garci tapes may be inadmissible but the paper trail to establish the facts stated in the Garci tapes and the testimonies of the participants including the authentication and testimony of the “producer” of the tape Agent Vidal Doble (Doble’s code name to hide his identity is “Double Agent”) partial authentication of Gloria herself in her “I am sorry” speech, the partial authentication of Ignacio Bunye and Garcillano himself, are all admissible, thereby reconstructing the contents of the tapes without having to present the content itself– if you do not know the procedure here  that you cannot hail Gloria to court up to now and  have to barter justice for the families of the 58 slain and the nation, then you are in the company of idiots. The complaints can be re-filed, they were dismissed at PI, that means without prejudice. Or maybe your legal team has been exposed to too much mercury when they went swimming.
